Synopsis
Suit was filed by Almond and her attorneys Earl Denham and Harvey Barton in order to prevent SRHS from terminating the pension plan. This was the first pension related suit filed. The case was assigned to Judge Jaye Bradley, who recused herself, and was then assigned to Judge Neil Harris. Harris entered a TRO to prevent the plan’s termination. SRHS removed the suit to Federal Court.
After the case was sent back to Chancery Court, SRHS then sought to have Judge Harris recused. The fight went to the Supreme Court, who eventually recused Judge Harris. They then appointed retired Judge Breland Hilburn to oversee SRHS pension related litigation.
